Is promoting specialized services to patients considered marketing?

According to HIPAA, any communication encouraging recipients to purchase or use a product qualifies as marketing, requiring prior written authorizations from patients before their PHI can be used for these purposes. Promoting specialized services to patients would be considered marketing under HIPAA if sent through means other than face-to-face interactions as it would serve the purpose of encouraging recipients to purchase and use a product.

What is considered marketing under HIPAA?

A Missouri Medicine journal article notes,For healthcare professionals, social media stardom and paid marketing campaigns carry risks and must be thoroughly considered and vetted.HIPAA provides a broad definition for marketing including promotional emails, advertisements, and any outreach efforts that aim to influence patient's decisions about healthcare products.

The Privacy Rule requires covered entities to obtain written authorizations from patients before using or disclosing their protected health information (PHI) for marketing purposes. There are exceptions to this rule, for example, communications that are purely information about a healthcare provider’s services or that do not promote a specific product do not require prior authorization.

How to ensure promotions remain HIPAA compliant

  1. Secure informed, written authorization from patients before using their PHI for marketing purposes. It should be clearly explained how their data will be used and provide an easy opt-out option.
  2. Establish business associate agreements (BAAs) with third-party vendors or marketing partners to ensure they comply with HIPAA regarding PHI privacy and security.
  3. Do not use or disclose sensitive health information for targeted marketing without obtaining prior patient authorization.
  4. Focus on general or non-PHI based promotions when consent is not available.
  5. Ensure patient lists are segmented appropriately to avoid sending communications based on sensitive health conditions or treatments without consent. HIPAA compliant email platforms like Paubox allow for secure transmission and storage and easy segmentation.
  6. Provide regular training for all team members involved in marketing to ensure they understand HIPAA rules and how to avoid violations.
  7. Assess promotional materials to ensure they do not inadvertently disclose PHI or violate HIPAA guidelines.
  8. Use demographic data, general health trends, or anonymized information for audience targeting instead of PHI when possible.
  9. If financial remuneration is received for marketing a product or service, ensure explicit patient authorization is obtained.
  10. Include clear instructions for patients to opt out of promotional communications at any time, ensuring they feel in control of their data and choices.
