Many vendors market their products as secure or healthcare-friendly, yet HIPAA compliance depends on something much more specific: how the tool handles protected health information, what the vendor does with that data, and whether the right legal, technical, and operational safeguards are in place. Research from BMC Bioinformatics shows that even advanced healthcare platforms can achieve near-perfect technical performance, such as 100% species identification accuracy and over 90% concordance in complex analyses, while still struggling with usability, infrastructure, and privacy requirements in real-world healthcare settings.
A healthcare organization cannot judge an AI product solely on its features. It has to ask whether the tool touches protected health information (PHI), whether the vendor acts as a business associate, and whether the safeguards go beyond a signed contract. That is where the real compliance test begins. Organizations that ask these questions early can better identify which AI tools create privacy and security risks.
Start with the first question: Does the AI touch PHI?
In healthcare, AI systems are increasingly used to analyze data from electronic health records, medical images, wearables, clinical documentation, and virtual health assistants, which means many tools come into contact with identifiable patient information during collection, processing, summarization, or output generation.
When an AI tool gets information about a patient's appointments, symptoms, diagnoses, drugs, physician notes, imaging, or transcripts, the compliance risk changes because the system is no longer dealing with abstract data. It is dealing with information that, if not managed correctly, could put privacy, trust, and security at risk.

When an EHR vendor collects patient data for the health system, it can act as a business associate. When a digital health vendor like Google does analytics for a provider on that provider's behalf, it can also be covered by HIPAA as a business associate. That makes sense for AI vendors as well. If the vendor stores prompts, analyzes patient data, retains user input, hosts the model environment where PHI is processed for analysis, or uses patient-linked data to support documentation, triage, summarization, or other healthcare tasks, the vendor is not just providing a neutral tool.
Why a BAA alone is not enough
A business associate agreement is necessary, but it does not make an AI vendor safe or a healthcare deployment compliant on its own. HIPAA compliance still hinges on whether the company has figured out what the risks are related to how PHI is collected, stored, accessed, processed, shared, and disposed of across the whole workflow. The JAMIA study offers guidelines on how to follow HIPAA and use cloud-based health systems.
These guidelines make it clear that contracts must be backed up by real operational controls, such as security responsibilities, audit mechanisms, plans for detecting and responding to incidents, and rules for how data will be returned or destroyed when the relationship ends. A signed BAA does not replace the administrative, physical, and technical safeguards that are needed to secure electronic PHI. It also does not get rid of the requirement for staff training, breach response processes, or regular reviews of vulnerabilities.
