Voicemail transcription can make work easier for many healthcare providers. Instead of listening to a message, they can simply read what someone said. However, voicemail can often contain protected health information (PHI) that needs appropriate safeguards to protect patient privacy. Let's review if Voxist is a HIPAA compliant way to receive voicemail transcriptions.
Is Voxist HIPAA compliant?
Before choosing a voicemail transcription tool, covered entities need to consider HIPAA compliance. HIPAA breaches can happen in a myriad of ways, including with voicemail transcriptions. For that reason, covered entities will need to work with business associates that are willing to participate in a business associate agreement (BAA). The agreement covers the legal responsibilities and duties a business associate has in keeping PHI confidential. If this agreement doesn't exist between both parties, then the relationship is not HIPAA compliant.
Voxist doesn't seem willing to participate in a BAA. It says on its Terms and Conditions that "In no event shall Voxist SAS...be liable for any indirect, incidental, special, consequential or punitive damages, including…(loss of) data," and this includes if the loss is a result from "unauthorized access, use or alteration of your transmissions or content." In addition to not wanting to take responsibility for data loss, it also doesn't have the appropriate data safeguards in place to protect PHI. There is no mention of encryption or any other safeguard to prevent the unauthorized access of data.
Conclusion
Voxist is not a HIPAA compliance voicemail transcription tool. The company isn't willing to sign a BAA nor does it have safeguards to ensure the confidentiality of PHI.
