What is Sendinblue?
Sendinblue was founded in 2007 to serve the needs of digital marketing agencies. Today, the company says it sends over 100 million emails every day and has over 80,000 customers in over 160 companies. Sendinblue proclaims that it offers "all your digital marketing tools in one place," and many of them involve communicating with and marketing to customers: email marketing, SMS marketing, chat, transactional email, and marketing automation. In addition, Sendinblue provides landing pages, signup forms, web ad retargeting and integrated Facebook Ads management. For the more technically adept customer, the company also provides an API (application programming interface) which "gives developers access to the entire range of Sendinblue features."Is Sendinblue HIPAA compliant?
The Sendinblue homepage says, "Your data privacy and security are a top concern for us," but only points to its efforts to comply with the General Data Protection Regulation (GDPR) in Europe. The company also provides limited information on its email encryption. The Sendinblue Terms of Use do not reference HIPAA, and also includes this prohibition in section 4.2.1, "Responsibility of the Users in relation to personal data":...the Users shall undertake not to include in the distribution lists uploaded onto the Sendinblue platform any personal data known as “sensitive” within the meaning of Article 9 of the GDPR, and in particular no health data, but also no data relating to criminal convictions and offences, any social security number, or any bank card number. The company further disavows any responsibility for the presence of health or other personal data on its platform and makes clear that the user must indemnify Sendinblue and will be solely responsible for any consequences of a data breach. Finally, a search for HIPAA in Sendinblue documentation in its help center finds no results.
Conclusion
Given the specific prohibition against health information in its Terms of Use, as well as the lack of HIPAA-specific information on its website, it's safe to assume that Sendinblue is not HIPAA compliant.HIPAA email marketing tools comparison
